These terms apply to every order placed on this site. Please read them before you order — by paying for an order you agree to them.
This site is operated by Wholefood Earth Ltd, 59-63 Hopes Lane, Ramsgate CT12 6UW, Kent, United Kingdom (registered in England & Wales, company number 09650943, VAT GB 227645691). "We" and "us" mean that company. You can reach us at [email protected].
This is a trade site. We sell to businesses, not to consumers. By ordering you confirm that you are buying in the course of a business and that you have authority to bind that business. If you want to buy for personal use, please use our retail shop.
We sell food ingredients in bulk, in whole sacks or cases, on pallets. These are natural products: colour, size and appearance vary between lots, and photographs are illustrative. Specification sheets, certificates and lot documentation are available for every order. Nothing on this site is advice on the suitability of a product for your particular use — that is for you to assess.
Prices are shown per kilogram in pounds sterling and exclude VAT. Most food lines are zero-rated; where VAT applies it is shown at checkout and charged at the rate in force. Delivery is charged per pallet and shown in the cart before you pay. We take care to price correctly, but if a price is obviously wrong we may cancel the order and refund you in full.
Each product has a minimum quantity and is sold in whole sacks; quantities are rounded up to the next whole sack and the cart shows you the change. Orders travel on pallets, and each pallet must be filled within the limits shown in the cart. Your order is an offer to buy. A contract is made when we send you an order confirmation after payment. We may decline an order — for example if a product has become unavailable — and if we do, we refund everything you paid for it.
Payment is by card at checkout, taken in full when you order, through Stripe. We never see or store your card number. Card payments are collected on our behalf by our platform provider.
We deliver to mainland UK addresses. Goods are despatched on pallets directly from the warehouse, normally within 1 to 5 working days of your order. That window is an estimate, not a guaranteed date, and time of delivery is not of the essence.
Delivery is to the kerbside or goods-in point. At checkout you tell us your goods-in hours, whether delivery must be booked in, whether you have a forklift and any access restrictions. We and the carrier rely on that information. If a delivery fails, or the vehicle is kept waiting, because the information was wrong or nobody was available to receive the goods, we may pass on the carrier's redelivery, waiting or storage charges.
Please check the goods when they arrive. Note any visible damage or shortage on the carrier's paperwork before signing, and tell us within 2 working days, with photographs.
The goods are at your risk from delivery. Ownership passes to you once we have received payment in full and the goods have been delivered.
Orders are passed to the warehouse as soon as they are paid, so please contact us straight away if you need to change or cancel. If the goods have not been despatched we will do what we can, and may deduct costs we have already incurred. Because these are food products, we cannot accept returns of goods that were correctly supplied.
If goods are damaged, short, or not as described, tell us within 2 working days of delivery for anything visible on arrival, and within 5 working days of discovering any other defect, giving the lot details and photographs, and keep the goods available for inspection. Where a claim is valid we will, at our choice, replace the goods or refund their price. Store the goods as the specification requires; we are not responsible for deterioration caused by storage or handling after delivery.
Our products are packed and handled in environments that also handle nuts, peanuts, sesame, soya, mustard, celery and cereals containing gluten. Allergen information is in each product's specification. If you process, repack or resell the goods, you are responsible for your own labelling, traceability and food-safety compliance.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability for an order is limited to the price you paid for it, and we are not liable for loss of profit, loss of business, or indirect or consequential loss. Terms implied by law are excluded as far as the law allows between businesses.
We are not in breach if we are delayed or prevented from performing by something outside our reasonable control, such as a supplier or carrier failure, a shortage, extreme weather, or action by an authority. If that lasts more than 30 days, either of us may cancel the affected order and we will refund what you paid for goods not delivered.
We use your details as set out in our privacy notice.
These terms, with your order confirmation, are the whole agreement for an order; your own purchasing terms do not apply. You may not transfer an order to someone else without our agreement. If part of these terms is found to be unenforceable, the rest still applies. Nobody other than you and us has rights under them. We may update these terms; the version in force when you order applies to that order.
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
